Onlineprinters connector for AI assistants (Claude, ChatGPT)

§ 1 Scope and conclusion of contract

These Terms of Use apply to the use of the Onlineprinters connector for AI assistants (server mcp.onlineprinters.com, "Connector"), which is developed and provided by Onlineprinters GmbH, Dr.-Mack-Straße 83, 90762 Fürth, Germany ("Onlineprinters").

The Connector connects AI assistants such as Claude (Anthropic) and ChatGPT (OpenAI) with Onlineprinters. The Connector is provided free of charge. The contract of use is concluded as soon as you connect the Connector with Onlineprinters and complete the connection.

The Connector can search for and configure print products, state list prices and non-binding delivery dates, and create a link to the shop or a cart link. Once you grant the Connector access to your Onlineprinters customer account, you can use it to read your orders, invoices and quotes from your customer account.

These Terms of Use are linked in the directories of the assistants and on the page for connecting the customer account.

§ 2 Right of use

For the duration of the contract of use, Onlineprinters grants you a simple, non-exclusive, non-transferable and non-sublicensable right to use the Connector within the supported AI assistants for personal or business purposes.

All rights in the Connector, including the software, content, trademarks and documentation, remain with Onlineprinters or the respective licensors.

Claude, ChatGPT, their interfaces and other third-party components are subject exclusively to the respective terms of use and licence terms of the respective rights holders.

§ 3 Restrictions on use

You may not modify, distribute, sell, rent or sublicense the Connector or allow third parties access to your connected customer account.

You also may not circumvent any technical protection measures, usage restrictions or security features, impair the Connector through automated, mass or abusive requests, or attempt to decompile, reverse engineer or otherwise discover the source code. Onlineprinters limits the number of requests per customer account. Mandatory statutory rights remain unaffected.

Copyright notices, trademarks and other identifying features may not be removed or altered.

§ 4 Responses of the assistant and your inputs

The Connector supplies the assistant with data from Onlineprinters. How the assistant reproduces, summarises or supplements this data is determined by the assistant, not by Onlineprinters. The information in the shop and in your customer account is authoritative.

You are solely responsible for ensuring that your inputs in the assistant are lawful and do not infringe the rights of third parties.

§ 5 Print files

Where the Connector offers adding a print file in your shop, the following also applies: you remain the owner of your print files and content. You are solely responsible for ensuring that the content you upload or hand over in the chat is lawful and does not infringe the rights of third parties, in particular copyrights, trademark rights, personality rights or data protection rights.

You grant Onlineprinters a non-exclusive right to reproduce and use your print files solely to the extent necessary to hand them over to the cart with the cart link and, if you place an order, to process your order. Onlineprinters acquires no further rights in your content.

The Connector checks a print file only for file type, size and complete transfer, not for its suitability for printing. This does not replace the check of the print data carried out as part of order processing and is no guarantee of a particular print result. Anyone who passes on a cart link with a print file thereby also passes on the print file.

If third parties assert claims against Onlineprinters on account of inputs, print files or other content originating from you, you shall indemnify Onlineprinters against these claims to the extent that the content is unlawful, in particular infringes the rights of third parties, and you are responsible for this. The indemnity also covers the necessary costs of legal defence.

§ 6 Prices, orders and delivery dates

Prices in the Connector are list prices for guidance. The price that the shop displays when you place your order is binding. Delivery dates are expected dates and not a commitment.

A cart link puts the item into the cart of the shop for which it was created only upon your click, at the shop price of that moment. It is valid for 24 hours.

A contract for printed products is concluded only by an order in the country-specific online shop of Onlineprinters selected for your order. Nothing is ordered and nothing is paid via the Connector. The general terms and conditions made available in this shop before you place your order apply to the purchase. Prices, delivery terms, right of withdrawal, warranty and liability for printed products are governed, subject to mandatory law, by the general terms and conditions of Onlineprinters, which are linked at the bottom of every page of the online shop.

§ 7 Your customer account at Onlineprinters

The Connector reads from your customer account only the areas that you approved when connecting (orders, invoices, quotes) and only within the scope of your permissions in the customer account. It changes nothing in your customer account: it does not place orders, does not cancel orders and does not change any details.

You connect your customer account once per assistant; a new connection in the same assistant replaces the old one. You can disconnect at any time on the page https://mcp.onlineprinters.com/oauth/disconnect. A connection that has not been used for 90 days ends on its own. After disconnection, no data is retrieved from your customer account.

§ 8 Right of withdrawal and its expiry

Consumers generally have a right of withdrawal in distance contracts. In a free-of-charge contract for the provision of digital content, the right of withdrawal expires as soon as Onlineprinters has begun to provide the Connector.

§ 9 AI assistants and data protection

The Connector is used within third-party AI assistants. Anthropic, OpenAI and other providers of assistants are not a party to these Terms of Use and are not responsible for the Connector or its functions.

Your use of the assistant is governed exclusively by the terms of use and the privacy policy of the respective provider. The processing of personal data by Onlineprinters in connection with the Connector is governed by the privacy notice of Onlineprinters for the Connector.

§ 10 Availability and updates

Onlineprinters endeavours to ensure that the Connector is available with as few interruptions as possible. However, availability and functionality also depend on circumstances beyond the control of Onlineprinters, in particular on the assistants and their providers, your internet connection, the respective technical environment, acts of third parties and force majeure. These circumstances and reasonable maintenance work may result in interruptions, delays or outages. Onlineprinters is entitled to update the Connector to the extent necessary to maintain or improve its security, compatibility, functionality or conformity with the contract. Where required by law, Onlineprinters provides necessary updates, in particular security updates, and informs you accordingly.

Onlineprinters will provide free software and security updates for the Connector for at least 24 months from the time at which the Connector is first made available to you, and at most for as long as the Connector is offered in a directory of the assistants. Updates of the assistants themselves and of other third-party components are governed by the applicable terms and update periods of the respective providers.

Statutory rights of consumers remain unaffected.

§ 11 Changes to the Connector

For consumers: Onlineprinters may make changes to the Connector that go beyond what is necessary to maintain its conformity with the contract if there is a valid reason for this, the changes cause you no additional costs and you are informed of the changes clearly and comprehensibly.

A valid reason exists in particular where a change is necessary to adapt the Connector to changed technical environments, interfaces or requirements of the assistants or their providers, an increased number of users, security requirements, legal requirements or other important operational requirements.

If the change impairs your access to the Connector or your use of the Connector by more than a minor degree, you will be informed in good time, on a durable medium, of the features and the timing of the change and of your statutory rights. In this case you have a statutory right to terminate the contract free of charge, unless the Connector continues to be provided to you unchanged and at no additional cost.

For businesses: Onlineprinters may further develop, change, restrict or discontinue the Connector for objective technical, security-related, legal or operational reasons. If a material change is foreseeable and advance notice is reasonable, Onlineprinters will inform you appropriately.

§ 12 Liability

12.1 Onlineprinters shall be liable without limitation:

(a) for damage caused intentionally or by gross negligence by Onlineprinters, its statutory representatives or vicarious agents;

(b) for damage resulting from injury to life, body or health caused by a negligent breach of duty by Onlineprinters, its statutory representatives or vicarious agents;

(c) for damage resulting from the fraudulent concealment of a defect or from a guarantee expressly assumed by Onlineprinters; and

(d) under the German Product Liability Act (Produkthaftungsgesetz) or other mandatory statutory liability.

12.2 In cases of slight negligence, Onlineprinters shall be liable only for a breach of a material contractual obligation and only for damage foreseeable at the time the agreement was concluded and typical of this agreement. 
This limitation does not apply to liability under Section 12.1 or to any mandatory statutory rights and remedies of consumers, including those under applicable laws governing digital products.

12.3 In all other cases, Onlineprinters’ liability for slight negligence is excluded to the extent permitted by applicable law.

12.4 This Section 12 does not apply to consumers whose habitual residence is in Austria. Their liability claims are governed by the applicable statutory provisions.  

§ 13  Term and termination

These Terms of Use remain in force for an indefinite period for as long as you use the Connector.

You may terminate the contract of use at any time by disconnecting your customer account, removing the Connector from the assistant or permanently ceasing use. Onlineprinters may terminate the contract of use with a notice period of 30 days. The right to terminate without notice for good cause remains unaffected.

Good cause exists for Onlineprinters in particular if you materially breach these Terms of Use, use the Connector improperly or continued use poses a specific security or legal risk. Onlineprinters will endeavour to inform you without undue delay of the reason for any blocking or termination and, where possible and reasonable, to give you the opportunity to remedy the breach. Statutory rights of consumers remain unaffected.

§ 14 Governing law and place of jurisdiction

The law of the Federal Republic of Germany applies, excluding the United Nations Convention on Contracts for the International Sale of Goods. As against consumers, this choice of law applies only insofar as it does not restrict the protection afforded by mandatory provisions of the law of the country in which the consumer has their habitual residence.

If the user is a merchant, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction is Fürth, Germany.

§ 15  Consumer dispute resolution

Onlineprinters is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

§ 16 Final provisions

The invalidity of individual provisions of these Terms of Use does not affect the validity of the remaining provisions. The statutory provisions apply in place of any invalid provision or any provision not incorporated into the contract.

These Terms of Use are available in German and English. In the event of any discrepancy between the two versions, the German version prevails.
